ADA Website Accessibility

Are you a person with blindness or visual impairment? Have you been denied access to a website due to your disability?

According to the National Federation of the Blind, it is estimated that more than 7,000,000 Americans are technically blind.

We, at the law office of Olga Nazimova, are passionate about fairness and fighting for the rights of disabled persons like you. Our office assists persons with blindness who have been unable to access and/or use a website that provides goods and services solely due to the website’s inaccessibility and compatibility with screen reader programs.

Today, the majority of us are conducting our daily activities online. It is imperative that persons with blindness be able to do the same. Many such activities have become second nature to all of us, activities such as online banking, shopping, applying for employment, online schools and tests, accessing cloud-based tools in the workplace, and so forth and so on. The ability to access the web became even more prevalent during the current Covid-19 pandemic, which brought to light how many websites where inaccessible to a person with blindness.

The Americans with Disabilities Act (ADA) applies to all businesses including: retail establishments, lodging, businesses serving food and drink, sales or rental businesses, service establishments, etc. and their respective websites, no matter where they are located. The Unruh Civil Rights Act (Unruh Act) provides even more protection to all disabled residents of California.

The Department of Justice (DOJ) has confirmed many times that the ADA and the Unruh Act apply to websites, and that websites are considered places of public accommodation. As of January 1, 2021, the DOJ required public, private, and non-profit organizations to ensure their websites and web content comply with WCAG 2.0 Level AA.

Unfortunately, most companies fail to recognize the injury and insult that their websites thrust upon persons with blindness. Through personal contact with my clients who are persons with blindness, I know of the difficulties they experience on a daily basis.

In our experience, a person with blindness simply contacting the website owner of this injustice and asking that they bring their website into compliance has rarely yielded any results. We, here at the Law Office of Olga Nazimova, have found that the only way to make change happen is to force the issue through legal intervention.
